Understanding the Digital Nomad Visa in South Africa

In an increasingly digital world, remote work has become the new norm. To accommodate this shift, South Africa has introduced the Digital Nomad Visa, formally known as the Visitor Visa with Authorization to Work Remotely. This visa offers remote workers the opportunity to live and work in South Africa, embracing its vibrant culture and diverse landscapes. However, understanding the nuances of this visa is crucial. In this article, we break down everything you need to know about the Digital Nomad Visa, including visa categories, restrictions, requirements, and duration. Whether you’re planning a temporary stay or an extended visit, DSD Immigration Attorneys is here to guide you through the process.

Visa Category and Restrictions:

The Digital Nomad Visa is issued under the Section 11 category of visitor visas. It is crucial to note that this visa cannot be converted to another visa type nor can its conditions be changed while you are in South Africa. The only exceptions to this rule are if the visa holder requires emergency medical treatment or if a spouse, life partner, child, or parent of a South African citizen or a holder of a business visa. This means the visa can only be renewed from within South Africa but cannot be switched to any other visa or used to apply for Permanent Residency from within the country.

Requirements:

Currently, there is no defined list of requirements for this specific visa. We anticipate that the Department of Home Affairs (DHA) will eventually issue a directive with detailed requirements. For now, the essential criteria are as follows:

The applicant must prove they are working for a foreign employer or have a foreign source of income with a gross annual income of at least one million rand.

If the visa is issued for a period exceeding six months within a 26-month period, the foreigner must register with the South African Revenue Service (SARS).

Duration:

The Digital Nomad Visa can be issued for up to three years at a time, which is the maximum period allowed under the visitor visa category.
